1. Agreement and eligibility

These Terms of Service (the “Terms”) are a binding agreement between you and BookMahj governing your access to BookMahj websites, applications, communications, and marketplace services (collectively, the “Platform”). “BookMahj,” “we,” “us,” and “our” refer to the operator of the Platform under the BookMahj trade name.

By creating an account, booking or paying for an offering, joining a waitlist, submitting an inquiry, or otherwise using the Platform, you accept these Terms and our Privacy Policy. You must be at least 18 years old and able to form a binding contract. If you use the Platform for an organization, you represent that you may bind it.

2. BookMahj’s marketplace role

BookMahj provides technology that helps independent instructors, hosts, clubs, and organizations (“Providers”) publish offerings, communicate with players, accept bookings, and receive payments. Providers—not BookMahj—create, price, describe, schedule, and deliver their classes, events, leagues, private lessons, and other services.

Unless a page expressly identifies BookMahj as the host, BookMahj is not a party to the service relationship between you and a Provider and does not employ, direct, endorse, or control Providers. We may support transactions, enforce Platform rules, or facilitate refunds without becoming the Provider of an offering.

3. Accounts and accurate information

You must provide accurate, current information; maintain one account for your own use; protect your credentials; and promptly update your contact details. You are responsible for activity under your account unless you promptly report unauthorized access.

We may verify email addresses, link eligible guest bookings to an account with the same verified email, and use third-party sign-in providers. Do not share claim, invitation, payment, or password-reset links. Contact support@bookmahj.comif you suspect misuse.

4. Listings, bookings, and participation

Listing details, availability, accessibility, venue rules, skill levels, materials, and participant requirements are supplied by the Provider. Review them before booking and ask the Provider questions through available inquiry tools. A booking is confirmed only when the Platform displays confirmation or sends a confirmation notice.

You must provide accurate attendee information, follow reasonable venue and safety rules, arrive as instructed, and treat Providers and participants respectfully. You are responsible for invited guests and may not resell, transfer, or exploit a booking except through a Platform-supported feature or with Provider approval.

5. Prices, fees, taxes, and payments

Before payment, the checkout shows the offering price and applicable taxes and fees. By confirming payment, you authorize BookMahj and Stripe to charge the displayed total using your selected payment method. Prices are generally charged in the currency displayed at checkout. Your issuer may impose separate conversion or banking fees.

BookMahj may collect a platform or service fee and may direct a Provider’s share to its Stripe connected account. Providers are responsible for taxes on their services and income; BookMahj may calculate, collect, report, or remit taxes when required. Stripe, not BookMahj, receives and processes full payment-card credentials.

6. Waitlists and payment authorization

Joining a waitlist does not guarantee a seat. Depending on the flow, you may receive a time-limited offer or authorize an automatic charge if space opens. When you affirmatively select auto-charge, you authorize the displayed amount to be charged to the selected payment method under the cancellation terms shown when you join.

Offers may expire, inventory can change, and a charge can fail. If the Platform charges you after capacity is no longer available, it may void or refund the transaction. Keep your contact and payment details current so time-sensitive notices can reach you.

7. Cancellations, refunds, and changes

Each offering uses the cancellation policy and cutoff displayed at booking or waitlist enrollment, including any Provider-authored custom terms. Those accepted terms control your cancellation eligibility. Except where law requires otherwise, late cancellations, no-shows, unused portions, and voluntary withdrawal are not refundable when the displayed policy says so.

Providers may reschedule, relocate, modify, or cancel offerings. The applicable Provider is responsible for fulfillment and its stated cancellation commitments. BookMahj may process an approved or required refund to the original payment method. Processing time depends on Stripe and your financial institution, and Platform or processing fees may be nonrefundable when disclosed and permitted by law.

8. Payment disputes and chargebacks

Contact the Provider and BookMahj before initiating a chargeback so the issue can be investigated. You may not use a chargeback to obtain a refund contrary to accepted cancellation terms or after receiving the purchased service. We and the Provider may submit booking, attendance, communications, cancellation, and payment records to Stripe, financial institutions, and card networks to respond to a dispute. This section does not limit lawful chargeback rights.

9. Communications

You agree to receive transactional communications necessary to operate your account and bookings, including verification, confirmation, proposal, reminder, waitlist, schedule, cancellation, refund, safety, and support messages by email and, when enabled with your consent, SMS or push notification. Message and data rates may apply.

Marketing messages are optional. You can use notification settings, an unsubscribe link, or the instructions in an SMS to change eligible preferences. Opting out of marketing does not stop non-promotional service messages. Providers may contact you about an offering you booked or asked about, but may not use your information for unrelated marketing without a lawful basis and any required consent.

10. Content, reviews, and license

You retain ownership of text, reviews, responses, images, profile information, and other content you submit (“User Content”). You grant BookMahj a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, distribute, and otherwise use User Content to operate, secure, improve, and promote the Platform and the relevant offering or Provider. This license lasts while needed for those purposes, subject to our Privacy Policy and lawful deletion obligations.

You represent that you have all rights and permissions needed for User Content and that it is accurate and lawful. Reviews must reflect a genuine experience and disclose material incentives or relationships. Do not submit fake, manipulated, defamatory, infringing, private, obscene, or harassing content. We may investigate, label, decline to publish, or remove content that violates these Terms, while preserving honest positive and negative feedback.

11. Acceptable use

You may not use the Platform to:

  • break the law, facilitate fraud, or violate another person’s rights;
  • harass, discriminate against, threaten, exploit, or endanger anyone;
  • circumvent fees, access controls, booking limits, or cancellation rules;
  • scrape, copy, reverse engineer, overload, disrupt, or introduce malicious code;
  • misrepresent identity, affiliation, credentials, reviews, demand, availability, or pricing;
  • collect or use personal information beyond the purpose for which it was provided; or
  • use automated means to access the Platform without our written permission.

12. BookMahj intellectual property

The Platform, its software, design, compilation, logos, trademarks, and BookMahj-created content are owned by BookMahj or its licensors and are protected by law. Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable right to use the Platform for its intended purpose. No other rights are granted.

13. Third-party services

The Platform relies on third parties such as Stripe for payments, identity providers for sign-in, mapping and calendar providers for optional integrations, communications providers, and linked external sites. Their services and independent processing are governed by their terms and privacy notices. We are not responsible for third-party services we do not control, but this does not limit responsibility that cannot lawfully be excluded.

14. Suspension, termination, and account closure

You may stop using the Platform at any time and may request account closure by emailing support. We may restrict, suspend, or terminate access; remove content; cancel unconfirmed activity; or withhold features when reasonably necessary to address violations, fraud, payment risk, safety, legal obligations, or harm to users or the Platform. Where practicable, we will provide notice and an opportunity to resolve the issue.

Account closure does not cancel confirmed bookings or eliminate payment obligations, disputes, or records we must retain. Provisions that by nature should survive—including payment, content licenses for retained material, disclaimers, liability limits, indemnity, and dispute terms—survive termination.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” BOOKMAHJ DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS, PROVIDERS, PARTICIPANTS, VENUES, AVAILABILITY, RESULTS, OR USER CONTENT WILL BE ACCURATE, SAFE, SUITABLE, AVAILABLE, OR ERROR-FREE. PARTICIPATION IN IN-PERSON OR ONLINE ACTIVITIES INVOLVES RISKS YOU MUST EVALUATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKMAHJ AND ITS AFFILIATES, PERSONNEL, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM THE PLATFORM, PROVIDERS, OFFERINGS, USER CONTENT, OR THESE TERMS.

BOOKMAHJ’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF PLATFORM FEES YOU PAID BOOKMAHJ DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

17. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless BookMahj and its affiliates and personnel from third-party claims, damages, losses, liabilities, and reasonable legal fees arising from your User Content, your violation of these Terms or law, your misuse of the Platform, or your conduct toward a Provider or participant. This obligation does not cover BookMahj’s own gross negligence or willful misconduct.

18. Disputes and governing law

Before filing a claim, you and BookMahj agree to send a written description to support@bookmahj.comand attempt in good faith for 30 days to resolve it informally. These Terms and any dispute are governed by applicable United States federal law and the law of the U.S. state in which BookMahj has its principal place of business when the dispute arises, without regard to conflict-of-law rules.

Any court proceeding must be brought in a court of competent jurisdiction serving that principal place of business, except that either party may bring an eligible individual claim in small-claims court and a consumer may use any forum or protection that applicable law does not permit these Terms to waive. Nothing here prevents either party from seeking urgent injunctive relief for misuse of intellectual property, data, or access credentials.

19. Changes and general terms

We may update the Platform and these Terms. We will post the updated version and effective date and provide additional notice when required or when changes materially affect your rights. Continued use after the effective date means you accept the updated Terms; where law requires affirmative consent, we will request it.

These Terms and incorporated policies are the entire agreement about the Platform except for additional terms you separately accept, such as the Instructor Agreement or an offering’s cancellation terms. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, or transfer of the Platform. Electronic notices and acceptances satisfy writing requirements.
